The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) V4.2 because:

You have applied for entry clearance to the UK for 18 days. The information you have provided on your application form and the supporting documents you submit allows me to assess whether your circumstances and intentions are, on the balance of probabilities, as stated.

On your Visa Application Form (VAF) you have stated that you intend to visit your sister for 18 days. From 2013 until June 2016 you studied in the UK. You then returned to the UK as a visitor in March 2017 after being issued a 6 months visitor visa on 21 February 2017. On your previous application you stated that you intended to stay in the UK for 14 days to look for a university. Notwithstanding this you have stated on your VAF that you only returned to Russia on 19 August 2017. You therefore remained in the UK for 5.5 months. It is not clear what you did in the UK but I am not satisfied that such a prolonged stay is commensurate with the actions of a genuine visitor. This causes me to doubt your current intentions.

You are unemployed and financially dependent on your mother. From the documents you submitted she appears to have an income from a pension. This amounts to 5848 RUR (£75) (£1 = 78 RUR) a month. It is not clear from the evidence submitted where the savings are from and I am not satisfied that the funds in the account are genuinely available to you.

Taking all the evidence into consideration I am not satisfied that your current circumstances are such that you are genuinely seeking entry for a purpose that is permitted by the visitor routes (Appendix 4.2 (c)). Nor have you have shown that your circumstances are such that you will leave the UK at the end of your visit (Appendix V 4.2 (a)).

For the reasons above I am not satisfied that you have sufficient funds to cover all reasonable costs in relation to your visit including the cost of your journey, any costs relating to dependants and the cost of any planned activities. Your application for a visit visa has been refused under Appendix V4.2(e).

I have therefore refused your application because I am not satisfied, on the balance of probabilities, that you meet all of the requirements of the relevant Appendix of the United Kingdom Immigration Rules. Any future UK visa applications you make will be considered on their individual merits, however you are likely to be refused unless the circumstances of your application change. In relation to this decision there is no right of appeal or right to administrative review.

The Decision

You are applying for entry to the United Kingdom to attend an English language course between 21/07/14 and 14/09/14. You have stated in your application that you are currently a full time student at the *****. I note the letter dated 20/05/14 that states that you are in second course extramural studies at the *****. I have no further information regarding the precise course of study at this University, the attendance requirements and the relevance of your intended course of study in the United Kingdom.

I have further noted that you were refused entry to the United Kingdom on 18/05/14 after being issued with a visa following your application on 28/01/14. You have stated your intention to follow a course of English language tuition and submitted your confirmation of acceptance for study at Southbourne School of English. You had not indicated this intended study on your previous application and enquiries have established that this course was booked immediately following your refusal on 21/05/14. This does not indicate a clear plan for your intended studies in the United Kingdom. I have no further information regarding your further study dates and potential employment in Russia. I further note that you have not sought to explain the circumstances of your refused entry on 18/05/14 other than to state that «another type of visa for study English course» was required. On balance I am not satisfied that your intention to study and return to Russia are as stated.

I have noted your stated income of £1450 each month from savings, investments and property. You have stated that your mother will fund this course of study but I have no further information as to the source of your income whilst you are a full-time student. I note your mother's monthly income of 44000RUB (£754) from her employment since 01/01/11. Her bank account statement indicates a balance of 69205RUB (£1187) on 21/05/14. The cost of the course is £3254, for part-board accommodation with a host family, excluding travel to and from the United Kingdom. I have no further information as to the source of your stated personal income and the origin of funds used to meet the cost of this course.

I am not satisfied, on balance, that your intentions to visit the United Kingdom and leave after a short period are as stated. I am further not satisfied that you will be able to maintain and accommodate yourself adequately in the UK without work or recourse to public funds or meet the cost of your return, or onward, journey from the United Kingdom. Paragraph 41(i)(ii) and (vi)(vii) of HC 395.

I have therefore refused your application because I am not satisfied, on the balance of probabilities, that you meet all of the requirements of the relevant Paragraph of the United Kingdom Immigration Rules.

The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) V3.6 and V4.2 of Appendix V: Immigration Rules for Visitors because:

Under paragraph V3.6 of the Immigration Rules a person must automatically be refused entry clearance if false representations or documents are used (whether or not material to the application and whether or not to the applicant’s knowledge), or material facts are not disclosed in relation to the application. A false representation for these purposes is a lie, or a false statement in a visa application, made either orally or in writing. A false document includes:

- a genuine document that has been altered or tampered with;
- a counterfeit document (one that is completely false);
- a genuine document which is being used by an impostor;
- a genuine document which has been fraudulently obtained or issued;
- a genuine document which contains a falsified or counterfeit visa endorsement.

You have applied for entry clearance to visit the United Kingdom for 20 days to attend your son's graduation. In your application at question 27 you state you have not been refused a visa to the UK before. However, Home Office records show that you made an application on 14/05/2013 for entry clearance to the UK (IST/*****), which was refused on 04/06/2013. This application was submitted using a different passport (AC*****) to the one you have used for this application. Given this, I am satisfied that these details are material to your application and satisfied that you have failed to disclose material facts.

Because you have employed deception when completing your application form, the credibility of your application as a whole has been compromised. Given the statements you have made and the documents you have presented to support your application, I am not satisfied that you have shown that your intentions are as stated or that you intend to leave the UK at the end of your proposed visit.

I am satisfied that you have made false representations in support of your application and therefore I am not satisfied that your personal and financial circumstances are as stated by you. I am not satisfied that you are genuinely seeking entry as a visitor and that you intend to leave the UK at the end of your visit. Your application is refused under paragraphs V3.6 and V4.2 (a) & (c) of Appendix V of the Immigration Rules.

You should note that because this application for entry clearance has been refused under paragraph V3.6 of the Immigration Rules, any future applications will also be refused for the same reason, under paragraph 320 (7B) of the Immigration Rules or paragraph V3.7 of Appendix V of the Immigration Rules.

A refusal under paragraph V3.7 of the Immigration Rules may attract an automatic refusal period of up to 10 years. The period starts from the date of the previous event in which the deception or submission of falsified documents or information was employed. Any future UK visa applications you make will be considered on their individual merits however you are likely to be refused unless the circumstances of your application change.

In relation to this decision there is no right of appeal or right to administrative review.

The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) V4.2 and V4.3 of Appendix V: Immigration Rules for visitors because:

You state that you intend to come to the UK with your father for 16 days as a tourist. You state you have a sponsor however, in order to assess your application I have to take into account your personal and economic circumstances. It is your responsibility to satisfy me that your circumstances are such that if granted leave to enter, you will comply with all of the conditions attached to any such leave and that you will leave the UK on completion of the proposed visit.

You have stated that you are currently self-employed as *****, earning a monthly income of 120,000 RUB (£1,529.54 at current exchange rate) and that you propose to spend £450 on your visit. You have indicated that £400 will be funded by your father towards the visit. You have stated you spend 10,000 RUB (£127.46) on monthly living expenses and you have declared that you receive 180,000 RUB (£2,294.31) as other income from your family.

I have noted all of the documents you have submitted in support of your visa application but I am not satisfied that these demonstrate your self-employment and receipt of income as stated. The documents provided do not show your financial standing in Russia at present time and in absence of this evidence it is unclear whether you receive the stated income. This means I am not satisfied that you have accurately portrayed your personal and economic circumstances as stated and this leads me to doubt your intentions for wishing to travel to the UK.

In light of the above I am not satisfied as to your intentions in wishing to travel to the UK now. I am not satisfied that you genuinely intend a short visit only to the UK and that you will leave the UK at the end of the visit. Furthermore, I am not satisfied that you will be able to maintain and accommodate yourself adequately in the UK or meet the costs of your return or onward journey from the UK. Your application is therefore refused under Paragraph V4.2 (a), (c) and (e) of Appendix V of the Immigration Rules.

You have stated that your father will fund £400 towards the cost of your visit. However, the documents provided do not demonstrate your sponsor’s personal and financial circumstances. I am mindful of the fact that you have not shown if your sponsor is willing and able to provide you with support. I am therefore not satisfied that your sponsor can accommodate and will provide you with support for the intended duration of your stay. Your application for a visit visa has therefore been refused under Paragraph V4.3 (c)

Any future UK visa applications you make will be considered on their individual merits, however you are likely to be refused unless the circumstances of your application change. In relation to this decision there is no right of appeal or right to administrative review.

The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) 4.2 of Appendix V: Immigration Rules for Visitors because:

You state you will visit the UK for 7 days. You were previously granted entry clearance and stated an 8 day visit; however you visited 4 times on this visa and have declared two visits of month on length. The documents you have submitted do not explain this discrepancy and this casts serious doubt over your application as a whole.

You state you are self employed and earn RUR 45,000 a month (Approx £600, £1 = RUR 75); however the documents you have submitted do not demonstrate any business registration, activity, income earned or tax paid. You state you spend £150 a month on living expenses; however the documents you have submitted do not demonstrate this. The documents you have submitted do not demonstrate how you support yourself in Russia.

You state you have £900 for your trip. You have submitted your Bank Statement with a balance of RUR 356,000 (£4,747). You have provided no explanation as to the origin of these funds, and as such I am not satisfied that these funds are exclusively available to you. I am not satisfied that the documents you have submitted accurately reflect your financial circumstances.

In light of the above, I am not satisfied that you are genuinely seeking entry for a purpose that is permitted by the visitor routes or that you intend to leave the UK on completion of your visit. I am not satisfied that there are sufficient funds to adequately cover the cost of your visit and maintain and accommodate you for the duration of your visit, or meet the cost of your onward or return journey. V4.2 (a, c, e)

The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) V4.2 because:

You have applied for entry clearance to the UK for 10 days. The information you have provided on your application form and the supporting documents you submit allows me to assess whether your circumstances and intentions are, on the balance of probabilities, as stated.

On your Visa Application Form (VAF) you have stated that you are employed as a tax inspector for ***** and earn 97964 RUR (£1240) (£1 = 79 RUR) a month. As evidence of this you have submitted a letter of employment and a bank statement. The bank statement shows that your salary varies significantly from 2610 RUR (£33) TO 100,071 RUR (£1266) a month. Furthermore, the balance of your bank account is 29.12 RUR (£0.37). You are proposing to spend £1396 on this short visit to the UK. Given your apparent financial circumstances I am not satisfied that such a financial outlay on this trip is commensurate with your circumstances in Russia and this causes me to doubt your intentions. Taking all the evidence into consideration I am not satisfied that your current circumstances are such that you are genuinely seeking entry for a purpose that is permitted by the visitor routes (Appendix 4.2 (c)). Nor have you have shown that your circumstances are such that you will leave the UK at the end of your visit (Appendix V 4.2 (a)).

For the reasons above I am not satisfied that you have sufficient funds to cover all reasonable costs in relation to your visit including the cost of your journey, any costs relating to dependants and the cost of any planned activities. Your application for a visit visa has been refused under Appendix V4.2(e).

I have therefore refused your application because I am not satisfied, on the balance of probabilities, that you meet all of the requirements of the relevant Appendix of the United Kingdom Immigration Rules. Any future UK visa applications you make will be considered on their individual merits, however you are likely to be refused unless the circumstances of your application change. In relation to this decision there is no right of appeal or right to administrative review.

The Decision

You have applied for entry clearance to visit the UK branch of your employer. You state that you will remain in the UK for a period of 6 months and I note that the letter you have submitted in support of your application from ***** confirms that the aim of your visit is «to gain the knowledge from manufacture processes implemented in ***** and get detailed training in the owned position».

You have been employed as a chemical engineer with ***** in Russia since 27 February 2012. I have considered paragraph 46G(iii)(i)(a) of the Immigration Rules which states I must be satisfied that you are travelling to receive specific, on-off training techniques and work practices used in the UK.

I have considered that you have been in your current employment for over two and a half years, that you have applied for entry clearance with two of your colleagues who also state that they intend to visit the UK for the same purpose for a period of 6 months and that there is no explanation or breakdown as to what you will be doing for the time you are in the UK. I have also considered whether the purpose of your visit is to undertake one-off training techniques; however do not find it credible that you would be required to visit the UK for this protracted period to receive this training. In view of this I am not satisfied that you are a genuine business visitor or that you intend to leave the UK on completion of your visit. I am also not satisfied that you intend to carry out a permissible activity. 46G(i)(iii)(iii(i)(a)

I have therefore refused your application because I am not satisfied, on the balance of probabilities, that you meet all of the requirements of the relevant Paragraph of the United Kingdom Immigration Rules.

The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) 4.2 of Appendix V: Immigration Rules for Visitors because:

You have stated that you intend to visit a friend in the UK for a period of thirty days and for tourism.

You have submitted a letter of invitation from ****** along with a copy of his British passport bio-data page. The invitation letter from ****** invites you to visit him and indicates that you will stay at ***** home for the duration of your proposed visit. I note that you have provided your mother’s documents indicating financial sponsorship of your trip. I also acknowledge that you are a non-working student. I am satisfied that ***** would be able to accommodate you if you had a genuine personal relationship. However, it is not clear how you know your sponsor, when you last met or if you have met in person. Your application overall does not demonstrate that you have a personal relationship that would satisfy me that your sponsor would accommodate you. I am therefore not satisfied with your reasons for wishing to visit the UK now.

You have stated that you are a student and your application indicates that you do not work. You have provided evidence that you are a student at *****. You have stated that you spend £600 per month on living costs. However your application and the documents that you have provided do not demonstrate that this is the case. Given that you have indicated that you are completely financially dependent on your mother for the cost of this trip I would need to see more evidence of your personal expenditure to establish your financial circumstances in Russia to be satisfied that you are a genuine visitor to the UK and that you intend to leave at the end of your proposed stay.

Given the points raised above, I am not satisfied that you are genuinely seeking entry as a visitor to the UK or that you will leave at the end of the period specified by you. I am not satisfied that your sponsors have a genuine personal relationship with you and will provide support to you for the intended duration of your stay. I am also not satisfied that you will be able to maintain and accommodate yourself in the UK without recourse to public funds or taking employment, or that you can meet the cost of your onward or return journey from the UK. 4.2 (a) (c) (e) and 4.3 (a) (c) of Appendix V of the Immigration Rules for visitors.

The Decision

You have an invitation from a Google UK stating you are to attend the opening of the YouTube Lab in London. There is no information or evidence of your claimed companies contact and relationship with this company and therefore why this business trip is required. You have stated on your visa application from you are self-employed with *****. You have failed to enclose evidence from them to support this.

As evidence of your circumstances here in Russia you have sent different types of documents, however some of these are in Russian and no English translation has been provided. You were advised when you submitted your application that translations are required and further information is also available on the Visa Application Website. Given this, I am unable to assess these documents relevance to your application and therefore take them into consideration for the purpose of assessing your application.

As a result I am not satisfied that you are genuinely seeking entry as a business visitor and that you have legitimate business interests in the United Kingdom. In addition I am not satisfied that you intend to leave the United Kingdom at the end of your visit, or that you can be adequately maintained and accommodated in the United Kingdom or meet the cost of your return or onward journey. This means you have not met the requirements of paragraph 41 (ii) to (viii) and (x) to (xii). 46G(i)(ii) In light of this I am not satisfied that you intend to undertake one of the defined business activities. 46G(iii).

I have therefore refused your application because I am not satisfied, on the balance of probabilities, that you meet all of the requirements of the relevant Paragraph of the United Kingdom Immigration Rules. Your right of appeal is limited to the grounds referred to in section 84(1)(c) of the Nationality, Immigration and Asylum Act 2002.

The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) 4.2 of Appendix V: Immigration Rules for Visitors because:

You state you will visit the UK for 4 days. You state you are unemployed. You state you spend RUR 30,000 (£400, £1 = 75 RUR) a month on living expenses and earn RUR 500,000 (£6,667) a year from other sources; however the documents you have submitted do not demonstrate this. The documents you have submitted do not demonstrate how you support yourself in Russia.

You state you have RUR 60,000 (£800) for your trip. You have submitted your Bank Statement with a balance of RUR 210,000 (£2,800). You have provided no explanation as to the origin of these funds, and as such I am not satisfied that these funds are exclusively available to you. I am not satisfied that the documents you have submitted accurately reflect your financial circumstances.

In light of the above, I am not satisfied that you are genuinely seeking entry for a purpose that is permitted by the visitor routes or that you intend to leave the UK on completion of your visit. I am not satisfied that there are sufficient funds to adequately cover the cost of your visit and maintain and accommodate you for the duration of your visit, or meet the cost of your onward or return journey. V4.2 (a, c, e)

Any future UK visa applications you make will be considered on their individual merits, however you are likely to be refused unless your person circumstances change significantly between now and your next application or you provide compelling new evidence with your next application. In relation to this decision there is no right of appeal or right to administrative review.

    Добрый день! Подавала документы на гостевую визу в Великобританию. У подруги состоится свадьба. Приглашение от нее было получено на электронную почту. Все документы подготовлены и представлены. Но был получен отказ, по причине недоказанной близости с подругой. Можно ли что-то сделать для получения визы после отказа по данной причине? И какие документы подтверждают близость с подругой, если не факт приглашения на такое мероприятие?

      Добрый день, Анастасия! Вероятнее всего, в вашем случае есть и другая причина отказа в британской визе. Очень редко заявителям отказывают из-за недоказанной близости с принимающей стороной. Как правило, для подтверждения реальных отношений аппликанты прикладывают приглашение от друзей/родственников в Британии. Причем это должно быть не просто официальное сообщение в несколько строчек – адрес, телефон, фамилии, имена.

      Приглашение для визы в Великобританию – это подробное письмо с указанием примерных планов на поездку, а также с кратким рассказом о том, как вы познакомились, как поддерживаете контакт, часто ли встречаетесь, когда виделись в последний раз и т.д. Т.е. офицер не должен усомниться в том, что вы действительно друзья. Иногда заявители направляют в Посольство общие фотографии, доказательства совместных путешествий и пр.

      Но все же повторим: редко случаются отказы в визе из-за того, что офицер не поверил в реальность дружбы. Либо это действительно так, и ваши доказательства не были убедительными. Либо есть и другие причины. Например, в вашем финансовом благополучии. Просмотрите справки, полученные с работы и из банка, оцените их объективно. Помните, что низкий доход и/или небольшие накопления могут быть серьезным поводом для отказа.

      Также иногда аппликанты получают отказ из-за принимающей стороны. Возможно, у вашей подруги не все в порядке с историей переезда в Великобританию и/или получением постоянного статуса. Но если вы уверены, что таких проблем нет, и единственная причина – та, что указана в письме об отказе, то можно попытаться получить визу еще раз. Главное – расширить пакет документов и представить ситуацию как можно более убедительно.

    Здравствуйте! У меня официальное трудоустройство, но зарплату получаю наличными. Банковского счёта нет. Как подтвердить финансовую состоятельность, чтобы не было отказа в британской визе?

      Добрый день, Анна! Финансовую состоятельность требуется подтвердить документально. Если вы сами спонсируете свою поездку, то вам обязательно нужно подготовить справку о доходе и выписку из банка. Единственная альтернатива – бумаги от спонсора (супруг, родители). Если спонсора нет, то заявитель прикладывает свои документы. Учтите, что официальное трудоустройство не обязательно для Посольства. Более того, для Посольства не имеет значения, как вы устроены на работу. Главное – постоянный доход. Попросите работодателя подготовить подтверждение дохода. Это самая обычная справка о зарплате сотрудника.

      Отметим, что справка с работы для визы в Великобританию составляется в свободной форме. 2-НДФЛ прикладывать не нужно. Достаточно указать фактическую заработную плату, должность, стаж, контактные данные предприятия. В Налоговой службе проверять эти сведения Посольство точно не будет. Но справка с работы обязательна, без нее даже нет смысла обращаться за визой. Это же касается и выписки из банка. Но обращаем внимание: в справке о состоянии счета не должно быть указано, что вы открыли его только что и только что положили деньги. Можно ограничиться информацией о текущем остатке, без детализации.
