The Decision

You have applied for an entry clearance as a visitor to the UK for 9 days. I have considered your application against paragraph 41 of the Immigration Rules. I have used all the information presented to determine if the Immigration Rules have been met. In reaching my decision, which has been made on the balance of probabilities, I note the following points:

You have applied for entry clearance to visit the UK accompanying your children, one of whom is intending to participate at the Blackpool dance festival.

You state in your application that you have a monthly income of £2,500 with £1,700 available to you for your proposed visit and an estimated cost of £700. You have submitted a letter from your employer which states that you have a monthly salary of 44,400R (£965 exc £1=46R) and your previous years employment verifies this with an annual income of 531,797R (£11,561). Your actual income appears less than half of what you have stated, and with regards to your available finance of £1,700 being available to you, you have submitted 2 bank statements in your name which show balances of 300R (£6.52) and 5,131R (£111) which is significantly below the £1,700 you state is available to you. You have stated that you expect the cost to you to be £700 and it is considered that not only is your available funds, as shown in your bank statements, significantly lower than this, your hotel booking in itself is £875.

On the basis of these issues I am therefore not satisfied that you are genuinely seeking entry as a general visitor for a limited period as stated by you, not exceeding 6 months, nor am I satisfied that you intend to leave the United Kingdom at the end of the period of the visit as stated by you. I am also not satisfied that you will be adequately maintained and accommodated in the United Kingdom, or that you can meet the cost of your return or onward journey. 41(i)(ii)(vi)(vii)

I have therefore refused your application because I am not satisfied, on the balance of probabilities, that you meet all of the requirements of the relevant Paragraph of the United Kingdom Immigration Rules.

The Decision

I acknowledge that you have previously travelled to the UK. When coming to my decision I must take into account your personal circumstances. Please also note that each application for UK entry clearance is considered on its own merits.

You have provided an employment letter from *****, and I note that this letter appears to be signed by a family member. You have provided no independent evidence of your in the form on an income document or itemised bank statement. Therefore I am not satisfied from your employment letter alone that you are employed as you indicate.

You were previously granted for UK entry clearance for 5 days in April 2013. I note however that you travelled for a further 6 weeks from 26/08/13 until 06/10/13. You have now re-applied for a further 6 months UK entry clearance and you have stated that you intend to travel for 14 days.

I note however that the letter you have provided from the Church of Scientology states that the programme will require you stay in the UK no longer than 6 weeks. Given that you have stated that you recently spent 6 weeks in the UK receiving religious services, considering the inconsistencies in the information provided and considering the evidence provided of your personal circumstances, I am not satisfied as to your intentions for visiting the UK, that you will leave at the end of the period specified by you and that you do not intend to live for extended periods in the United Kingdom through frequent or successive visits 41 (i) and (ii).

I have therefore refused your application because I am not satisfied, on the balance of probabilities, that you meet all of the requirements of the relevant Paragraph of the United Kingdom Immigration Rules. Your right of appeal is limited to the grounds referred to in section 84(1)(c) of the Nationality, Immigration and Asylum Act 2002.

The Decision

I have used all that information to determine if the Immigration Rules have been met. In reaching my decision, which has been made on the balance of probabilities, I note the following points:

You have indicated that you intend to travel to the UK for a period of 30 days for a feature film production. Whilst I am satisfied, from your sponsor documents, that your sponsor would be able to support you during your visit, I must be satisfied of your personal circumstances and the intention surrounding your trip. You have stated on your application form that you earn a monthly income of 100,000 RUB (£1,988); however you have not provided evidence of these earnings. I note that you have provided a bank statement with a closing balance of £20,505 and a letter from your employer ZAO *****, but neither of these documents demonstrates what your earnings are each month. Furthermore you have not satisfactorily explained the origin of these funds and therefore I cannot be satisfied that the statement is an accurate reflection of your financial circumstances. You have stated on your application form that your living costs are 50,000 RUB (£994), but it is unclear from your bank statement that this is a true reflection of your outgoings.

Furthermore I note that you were refused an application for settlement as the spouse of a British citizen in 2012 and this leads me to doubt your intentions in the UK. I am unclear of your current domestic and family circumstances, and given all of this I am not satisfied as to your intentions in wishing to travel to the United Kingdom now. In addition I am not satisfied that you intend to leave the United Kingdom at the end of your visit, or that you can be adequately maintained and accommodated in the United Kingdom or meet the cost of your return or onward journey. 46G(i)(ii) In light of this I am not satisfied that you intend to undertake one of the defined business activities 46G(iii)

I have therefore refused your application because I am not satisfied, on the balance of probabilities, that you meet all of the requirements of the relevant Paragraph of the United Kingdom Immigration Rules.

The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) 4.2 and 4.3 of Appendix V: Immigration Rules for Visitors because:

You state that you intend to visit the UK for 6 days to attend the concert of Stas Mikhailov at Troxy Concert Hall. You state that the organisers of this event will meet the costs relating to your visit. Whilst I acknowledge that you have submitted a letter from EU Events dated 04/10/16 confirming this, it is unclear from the documents that you have submitted and from the information on the visa application form why they would do so. I am therefore not satisfied that your intentions are as you state.

You state that are retired and have declared no income. You have stated you have a monthly expenditure of £100 per month. Whilst you have submitted evidence that you receive a monthly pension of 3,801 Roubles per month (£49), I note that this is half of what you have declared your living costs are. The documents you have submitted do not demonstrate how you financially support yourself in Russia as declared by you on the visa application form and as a result I am not satisfied that your financial circumstances are as you state.

I am therefore not satisfied that your intentions are as stated and that you are a genuine visitor or that you will leave the UK at the end of your visit. I am also not satisfied that you have sufficient funds to cover the costs related to your visit including your return or onward journey. 4.2(a)(c)(e) I am also not satisfied that your sponsor has a genuine professional or personal relationship with you. 4.3(a).

The Decision

You have applied for entry clearance in order to enter the United Kingdom for the purpose of tourism. I note that you have submitted evidence of your income in the form of a letter of employment which states that you earn RUR 60,000 (£1300) a month. On your application form you have stated that your trip to the UK will cost you UK £2000 and that you will pay for your trip yourself. However, you have provided no evidence as to what funds are available to you for this. This in itself is not satisfactory evidence that funds can be made available from your resources to pay for your trip. As a consequence I am unable to assess your circumstances in Russia which impact upon your incentive and intention to leave the United Kingdom at the end of your proposed visit. Nor can I be satisfied, from the evidence provided that there would be sufficient funds available to maintain and accommodate you in the United Kingdom without you working or without recourse to public funds.

Given all the above I am not satisfied as to your intentions for visiting the UK or that you will leave at the end of the period specified by you as required under paragraph 41 (i) and (ii) of the Immigration Rules or that that you will be able to maintain and accommodate yourself in the UK without recourse to public funds or taking employment, or that you can meet the cost of your onward journey or return journey from the UK as required by paragraphs 41 (vi) and (vii) of the United Kingdom Immigration Rules.

The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) 4.2 (a) and (e) of Appendix V: Immigration Rules for Visitors because:

In your Visa Application Form, you state that you intend to visit the United Kingdom for 3 days for the purpose of tourism. You state that you will travel alone and that you have no friends or family in the United Kingdom. You state that you will finance your trip from your own funds and that you have £448 (32,235 RUB) available for your trip. You expect that your trip will cost £448.

I note that you were previously refused a United Kingdom visa (Moscow/*****). The Entry Clearance Officer was not satisfied as to your intentions in travelling to the United Kingdom. He was also not satisfied as to the funds available to you for your visit. Your present application has been assessed on its own merits but I am entitled to consider your immigration history. I submit that your present application is broadly similar to your previous one.

In your Visa Application Form, you state that you are an investor and scientists relations manager. Your employers, ***** LLC, have submitted an employment letter, showing your average monthly salary as 42,000 Roubles (£584). You have also submitted 2 bank statements from Raiffeisen Bank, showing that you have accounts holding 2220 Euros (£1943) and 21,256 Roubles (£295). As with your previous application, the sources of your funds is not clear and I am not satisfied that these bank statements are a true demonstration of your financial position. I also submit that your proposal, to spend 3 week’s salary on a 3 day holiday, is not commensurate with your demonstrated income. In light of the foregoing, I am not satisfied as to your intentions in wishing to travel to the UK, nor am I satisfied that you genuinely intend a short visit only to the UK and that you will leave the UK at the end of the visit. In addition to this, I am not satisfied that you have sufficient funds to cover all reasonable costs in relation to your proposed visit without working or accessing public funds. Consequently, I refuse your application under Paragraphs 4.2 (a) and (e) of Appendix V of the Immigration Rules.

The Decision

I have used all the information presented to determine if the Immigration Rules have been met. In reaching my decision, which has been made on the balance of probabilities, I note the following points:

You are single with no dependants you work at ***** as an Information Manager earning USD1000 (£667) (£1=US$) of which you spend between US$500 and $750 (£333 - £500) per month on living expenses. You state that you do not receive an income from any other source and that you have no property. You have submitted two bank statements in your name with closing balances on euro0.04 and R5,995 (£130). I recognise that your sponsor proposes to bear the cost of your visit. I must take into account your personal and economic circumstances in Russia when coming to my decision. In view of this and the above I am not satisfied that you have sufficient ties to satisfy me that would in fact leave the UK on completion of your proposed visit. Therefore, on the balance of probabilities, I am not satisfied that you are genuinely seeking entry as a visitor for a limited period not exceeding 6 months or that you intend to leave the United Kingdom at the end of the visit as required by paragraph 41 (i) and (ii) of HC395

You have provided an invitation letter from your UK sponsor dated 28 January 2013 offering you accommodation. You have not provided evidence of his employment or accommodation, for example in the form of tenancy agreement, or mortgage or housing tax, and as such his ability to accommodate you as claimed. You have submitted your sponsor’s bank statement dated 12 February 2013 that shows him to be mostly overdrawn on his account, although I note a large deposit placed in the account on 11 February 2013 you have not provided evidence of their origin. This leads me to doubt that the funds are genuinely and exclusively available to him for your exclusive use Therefore, on the balance of probabilities, i am not satisfied that you will be maintained and accommodated in the UK without working or having recourse to public funds or are able to meet the cost of return or an onward journey as required by paragraph 41 (vi) and (vii) of HC395.

I have therefore refused your application because I am not satisfied, on the balance of probabilities, that you meet all of the requirements of the relevant Paragraph of the United Kingdom Immigration Rules.

The Decision

I have used all the information presented to determine if the Immigration Rules have been met. In reaching my decision, which has been made on the balance of probabilities, I note the following points:

I acknowledge the importance of maintaining family contact and have considered the compassionate aspects of your application. However it is the intentions of the applicant that are paramount in considering any application and I am not satisfied, on the balance of probabilities, that you meet the requirements of Paragraph 41 of the Immigration Rules.

The onus is on an applicant to demonstrate that they meet the requirements of the UK Immigration Rules. The UK Border Agency Website and British Embassy Moscow provide information to visa applicants about the types of documents that they should produce so that they can demonstrate to an Entry Clearance Officer that they meet the rules. We advise applicants that the failure to submit such documentation may result in refusal of their application. This decision has been made on the basis of the information and evidence that you have provided with this application. While I am aware that you have previously travelled to the UK, your last visa was issued over a year ago in January 2011 and each application is decided on its own merits.

You have stated that the costs of your visit would be met by yourself. As evidence of funds available to pay for your trip you have presented a letter of employment which states your monthly income. This in itself is not satisfactory evidence that funds can be made available from your resources to pay for your trip. In the absence of such evidence, for example in the form of your bank statements showing your financial commitments, it is unclear what funds are genuinely available exclusively to you to fund your trip. Furthermore, the letter from your employer does not confirm your continued employment with them, that you have been granted leave or that your position will be held open to you for the duration of your visit.

You have provided no details of any family ties, savings, property or other assets in Russia. As a consequence I am unable to assess your circumstances in Russia which impact upon your incentive and intention to leave the United Kingdom at the end of your proposed visit. Nor can I be satisfied, from the evidence provided that there would be sufficient funds available to maintain and accommodate you in the United Kingdom without you working or without recourse to public funds. Given all the above I am not satisfied as to your intentions for visiting the UK or that you will leave at the end of the period specified by you as required under paragraph 41 (i) and (ii) of the Immigration Rules or that that you will be able to maintain and accommodate yourself in the UK without recourse to public funds or taking employment, or that you can meet the cost of your onward journey or return journey from the UK as required by paragraphs 41 (vi) and (vii) of the United Kingdom Immigration Rules.

I have therefore refused your application because I am not satisfied, on the balance of probabilities, that you meet all of the requirements of the relevant Paragraph of the United Kingdom Immigration Rules.

The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) 3.6, 4.2 of Appendix V: Immigration Rules for Visitors because:

You propose visiting the UK for eight days. You stated in your application that you have not been refused a visa for any country, including the UK in the last ten years. However, our records show that you were refused a visa on 4/12/2007. You have not provided any explanation or supporting evidence with your application that would indicate you may have made an error. I am satisfied that you have made false representations in support of your application. Your application is therefore refused under Appendix V 3.6 of the Immigration Rules.

You should note that because this application for entry clearance has been refused under Appendix V 3.6 of the Immigration Rules, any future applications may also be refused under Appendix V 3.7 or paragraph 320 (7B) of the Immigration Rules.

A refusal under Appendix V 3.7 or paragraph 320 (7B) of the Immigration Rules may attract an automatic refusal period of up to 10 years. The period starts from the date of the previous event in which the deception or submission of falsified documents or information was employed.

Given the above, I am not satisfied that you are genuinely seeking entry as a visitor for a limited period not exceeding 6 months or that you intend to leave the United Kingdom at the end of the visit. 4.2 (a, c)

The Decision

The cost of your visit to the UK is to be borne by yourself. While you have provided evidence of your funds, you have failed to provide satisfactory evidence about the origin of these funds. You have failed to provide any evidence of your employment with ***** Ltd as stated on your visa application form. As a result, I am not satisfied that the evidence provided is a true reflection of your financial circumstances or that these funds are available to you. Therefore, on the balance of probabilities, I am not satisfied that you will be maintained and accommodated in the UK without working or having recourse to public funds or are able to meet the cost of return or an onward journey as required by paragraph 41 (vi) and (vii) of HC395.

I must take into account your personal and economic circumstances in Russia when coming to my decision. Therefore, on the balance of probabilities, I am not satisfied that you are genuinely seeking entry as a visitor for a limited period not exceeding 6 months or that you intend to leave the United Kingdom at the end of the visit as required by paragraph 41 (i) and (ii) of HC395.

I have therefore refused your application because I am not satisfied, on the balance of probabilities, that you meet all of the requirements of the relevant Paragraph of the United Kingdom Immigration Rules.

    Добрый день! Подавала документы на гостевую визу в Великобританию. У подруги состоится свадьба. Приглашение от нее было получено на электронную почту. Все документы подготовлены и представлены. Но был получен отказ, по причине недоказанной близости с подругой. Можно ли что-то сделать для получения визы после отказа по данной причине? И какие документы подтверждают близость с подругой, если не факт приглашения на такое мероприятие?

      Добрый день, Анастасия! Вероятнее всего, в вашем случае есть и другая причина отказа в британской визе. Очень редко заявителям отказывают из-за недоказанной близости с принимающей стороной. Как правило, для подтверждения реальных отношений аппликанты прикладывают приглашение от друзей/родственников в Британии. Причем это должно быть не просто официальное сообщение в несколько строчек – адрес, телефон, фамилии, имена.

      Приглашение для визы в Великобританию – это подробное письмо с указанием примерных планов на поездку, а также с кратким рассказом о том, как вы познакомились, как поддерживаете контакт, часто ли встречаетесь, когда виделись в последний раз и т.д. Т.е. офицер не должен усомниться в том, что вы действительно друзья. Иногда заявители направляют в Посольство общие фотографии, доказательства совместных путешествий и пр.

      Но все же повторим: редко случаются отказы в визе из-за того, что офицер не поверил в реальность дружбы. Либо это действительно так, и ваши доказательства не были убедительными. Либо есть и другие причины. Например, в вашем финансовом благополучии. Просмотрите справки, полученные с работы и из банка, оцените их объективно. Помните, что низкий доход и/или небольшие накопления могут быть серьезным поводом для отказа.

      Также иногда аппликанты получают отказ из-за принимающей стороны. Возможно, у вашей подруги не все в порядке с историей переезда в Великобританию и/или получением постоянного статуса. Но если вы уверены, что таких проблем нет, и единственная причина – та, что указана в письме об отказе, то можно попытаться получить визу еще раз. Главное – расширить пакет документов и представить ситуацию как можно более убедительно.

    Здравствуйте! У меня официальное трудоустройство, но зарплату получаю наличными. Банковского счёта нет. Как подтвердить финансовую состоятельность, чтобы не было отказа в британской визе?

      Добрый день, Анна! Финансовую состоятельность требуется подтвердить документально. Если вы сами спонсируете свою поездку, то вам обязательно нужно подготовить справку о доходе и выписку из банка. Единственная альтернатива – бумаги от спонсора (супруг, родители). Если спонсора нет, то заявитель прикладывает свои документы. Учтите, что официальное трудоустройство не обязательно для Посольства. Более того, для Посольства не имеет значения, как вы устроены на работу. Главное – постоянный доход. Попросите работодателя подготовить подтверждение дохода. Это самая обычная справка о зарплате сотрудника.

      Отметим, что справка с работы для визы в Великобританию составляется в свободной форме. 2-НДФЛ прикладывать не нужно. Достаточно указать фактическую заработную плату, должность, стаж, контактные данные предприятия. В Налоговой службе проверять эти сведения Посольство точно не будет. Но справка с работы обязательна, без нее даже нет смысла обращаться за визой. Это же касается и выписки из банка. Но обращаем внимание: в справке о состоянии счета не должно быть указано, что вы открыли его только что и только что положили деньги. Можно ограничиться информацией о текущем остатке, без детализации.
