The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) 4 of Appendix V: Immigration Rules for Visitors because:

You have applied for a visa to visit the UK as a tourist. Along with your application you have submitted evidence of your employment and a hank letter showing an account in your name; also evidence of your sponsor's willingness and ability to sponsor you on this trip. You have also submitted evidence of a property of which you have a one quarter share of ownership and a second of which you have a one eighth share of ownership.

You state that you are employed and earn £209 per month. You have submitted a letter from the bank showing an account in your name with a closing balance of RUR72615 (£726) (£1=RUR100). You have stated that you spend £100 on cost of living expenses leaving £100 as disposable income. You have stated that the cost to you of this trip is £200 which amounts to a month’s total pay or 2 month’s disposable income. I acknowledge that you mother is to part sponsor your trip; however I also note that the cost of the trip is approximately £800 which equates to about 4 months of your total salary.

You have submitted evidence of your mother’s employment and her salary is stated as RUR75300 (£753) as well as a letter from the bank showing an account in her name showing a closing balance ot RUR170049 (£1704). You state that she is to sponsor you an amount of £600 which equates to almost a month’s total salary or approximately one third of her total savings. The evidence that you have submitted does not show your mother’s personal and financial circumstances furthermore the letter from the bank does not satisfactory show the origin of these funds. I am therefore not satisfied that these funds will be available for your exclusive use.

Given the paragraphs above, and considering the balance of probabilities, I am not satisfied as to your intentions for visiting the UK, that you will leave at the end of the period specified by you nor that you will be able to maintain and accommodate yourself in the UK without recourse to public funds or taking employment, or that you can meet the cost of your onward journey or return journey from the UK as required by paragraph 4 of Appendix V of the United Kingdom Immigration Rules. Appendix V4.2 (a)(c)(d)(e)

The Decision

You have applied to enter the UK for 4 weeks. You have stated that you are a Project Manager at ***** and have provided an employment letter as evidence that you work for ***** and that you are being dispatched to the UK in order to participate in on-site knowledge transfer and planning meetings with ***** business analysts. I further note that your employer states that you will not engage in project management duties and that the need for such short-term visits is on-going starting in June 2016.I acknowledge that you have also provided an invitation letter from *****, who state they have a business contract with *****, to this effect.

I understand that you have previously been issued a UK six month business visitor visa on 07/11/2013 and on that application you stated that you intended to conduct a two week business trip to meet with *****. The information that you have provided on your visa application and the stamps in your passport indicate that you made three business trips to the UK resulting in a total stay of just over four months. I note that the first trip you made to the UK was on 17/11/2013 and that you stayed for just over one month. This was then followed by a further two month trip from 05/01/2014. This was then followed by a further one month visit from 08/04/14. Whilst I am aware two years have passed since this time, the business trip that you propose making is similar to that stated in your previous application. I acknowledge that you have provided a letter from *****. However looking at the time that you spent in the UK on the last visa and given that you have presented similar circumstances today, I am not satisfied that you intend a short trip of four weeks as stated by you and that your intention is to attend business meetings.

In view of these concerns, I am not satisfied with your reasons for wishing to visit the UK now or that your presence in the UK will not lead to you carrying out activities purporting to work, which is not permitted by Appendix V of the Immigration rules. Equally, I am also not satisfied that you will leave at the end of the period as stated by you. As a result I am not satisfied that you are seeking entry as a genuine visitor to undertake a business activity listed in Appendix 3, (sub sections 5 and 6) of the Immigration Rules for visitors. Your application has therefore been refused under Paragraph V4.2 (c).

The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph V4.2 of Appendix V: Immigration Rules for Visitors because:

I acknowledge that you have travelled to the UK on several previous occasions. However, from the information you have provided I am satisfied your intentions in applying for this latest visa are different from those at the time of your previous visits.

You have applied for a 5 year visa and indicated that you intend to spend 6 month in the UK each year. This would mean you spending 2.5 years in the UK over the duration of this visa. I am satisfied from the information you have provided that it is your intention to live in the UK for extended periods through frequent or successive visits.

You have stated at question 68 that the reason you want to travel to the UK is to help your daughter to bring up her children and to take a vacation. You have separately provided a doctors letter regarding your daughters current state of health and a letter from your daughter that her health is poor and you will help with every day family responsibilities. While I acknowledge both the importance of family visits and have considered the compassionate nature of the points you have raised I am not satisfied the reasons for your travel and the frequency and duration of your visits meet the requirements of Appendix V of the Immigration Rules.

Appendix 3 of Appendix V lists the activities that are permitted by visitors. This includes a variety of business related activities as well as travelling for tourism or visiting family and friends. It does not include the provision of long term child care. I accept that it is reasonable for visiting family members to assist in the home including caring for children during short visits but what you have detailed goes well beyond that. Your assistance appears to be of a long term nature and it is not clear what provisions are in place for the periods where you would not be in the UK. I am satisfied that the duration specified by you over which this support would be provided would constitute employment even if that employment was not paid. I am not satisfied that the reasons for your travel are amongst those permitted by Appendix 3 of Appendix V.

In light of the above, I am not satisfied that you are seeking entry as a genuine visitor or that you intend to leave the UK on completion of your visit. I am not satisfied that you do not intend to remain in the UK for extended periods through frequent or extended visits or that the reasons for your visit fall amongst those permitted by Appendix 3 of Appendix V. V4.2 (a, b, c)

I have therefore refused your application because I am not satisfied, on the balance of probabilities, that you meet all of the requirements of the relevant Paragraph of the United Kingdom Immigration Rules.

The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) 4.2 and 4.3 of Appendix V: Immigration Rules for Visitors because:

You have provided details of a sponsor and provided letter of invite, however, in order to be able to make a decision on whether or not to grant you entry clearance in this category I must take into account your stated personal circumstances in Russia, the reasons for your visit and your proposed travel arrangements.

You have declared that you are employed as a Teacher of Technologies at *****, earning £937 per month, you will travel to the UK for 14 days and you have £380. You have provided a bank statement which states you have RUB 90,800.00 (£1,189.79) within this account but I have been unable to establish the source that created this amount. In addition, from the information you have provided, I have been unable to confirm that you receive any form of proven monthly income from the salary you state being deposited into a bank account in your name and I am therefore not satisfied that you will have sufficient funds to provide for yourself for the whole duration of your visit.

You state that you will visit a family friend who resides in the UK and you have provided a letter of sponsorship and passport, however, from the information provided, I have been unable to establish their current financial circumstances and that they are able to provide you with all maintenance and care and have adequate accommodation to provide for you for the whole duration of your stay.

From the information provided, I have not been able to confirm your receipt of a regular proven income, nor of how you are supported on a daily basis or of any family members currently in Russia. As such I am not satisfied that you have provided an accurate portrayal of your current personal circumstances.

In light of all of the above I am not satisfied as to your intentions in wishing to travel to the UK now. I am not satisfied that you are genuinely seeking entry for a purpose that is permitted by the visitor routes, not satisfied that you will leave the UK at the end of the visit and that you will be able to maintain and accommodate yourself adequately in the UK or meet the costs of your return or onward journey from the UK. Your application is refused under Appendix V4.2 (a) (c) and (e) of the Immigration Rules.

Furthermore, I am not satisfied that it has been demonstrated that you have a genuine professional or personal relationship with your sponsor, and that they can and will provide support to you for the intended duration of your stay in the UK. Your application is also refused under Appendix V4.3 (a) and (c) of the Immigration Rules.

The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph V4.2 and V4.3 of Appendix V: Immigration Rules for Visitors because:

You state you will visit the UK for 12 days, to visit Mr *****, You have provided no evidence that you have met before or how you have an acquaintance. I note that your sponsor is funding 50% your trip. You have not demonstrated a genuine professional or personal relationship. (V4.3) (A) or indeed that he holds the estimated funds.

You state you are employed by ***** and earn 45000RUR a month (£613 where £1 = 73.4RUR) however the documents you have submitted do not demonstrate your stated salary. You have submitted a bank statement which shows a one off balance with no outgoings or credits. The documents you have submitted do not demonstrate any salary payments. The documents you have submitted do not demonstrate how you support yourself in Russia.

You state you have £1100 for your trip which represents 1.7 months of your stated salary. You have submitted a Bank Statement stating a balance of 102759RUR or £1399. This is a shown as a one off balance. You have provided no details of incomings or outgoings or proof as to the origin of the funds, and as such I am not satisfied that they are exclusively under your control. You have not demonstrated your salary or that the trip is justifiable to your circumstance. I am not satisfied that these documents accurately reflect your financial circumstances.

In light of the above, I am not satisfied that you are seeking entry as a genuine visitor or that you intend to leave the UK on completion of your visit. I am not satisfied that there are sufficient funds to adequately cover the cost of your visit and maintain and accommodate you for the duration of your visit, or meet the cost of your onward or return journey. V4.2 (A, C, E)

The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) 4.2 of Appendix V: Immigration Rules for Visitors because:

In order to be able to make a decision on whether or not to grant you entry clearance in this category I have taken into account your stated circumstances in Russia, the reasons for your visit and your proposed travel arrangements. You have declared that you are employed as the CEO of ***** LLC and that you will travel to the UK for 11 to meet potential clients at a personal cost of £2,000.

From the information provided, I have not been able to establish your current employment circumstances, how you are supported on a daily basis, and how you will finance your visit. In addition, I have not been able to confirm that you have made any arrangements for your business purposes in the UK and that you will have any employment to return to on the completion of your planned visit. As such I am not satisfied that you have provided an accurate portrayal of your current personal circumstances.

In light of all of the above I am not satisfied as to your intentions in wishing to travel to the UK now. I am not satisfied that you are genuinely seeking entry for a purpose that is permitted by the visitor routes, not satisfied that you will leave the UK at the end of the visit and that you will be able to maintain and accommodate yourself adequately in the UK or meet the costs of your return or onward journey from the UK. Appendix V4.2(a)(c)(e)

The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) 4.2 of Appendix V: Immigration Rules for Visitors because:

You state you will visit the UK for 7 days. You state you are a student. You state you spend RUR 20,000 (£267, £1 = 75 RUR) a month on living expenses; however the documents you have submitted do not demonstrate this. The documents you have submitted do not demonstrate how you support yourself in Russia.

You state you have £500 for your trip; however the documents you have submitted do not demonstrate this. I am not satisfied that the documents you have submitted accurately reflect your financial circumstances.

In light of the above, I am not satisfied that you are genuinely seeking entry for a purpose that is permitted by the visitor routes or that you intend to leave the UK on completion of your visit. I am not satisfied that there are sufficient funds to adequately cover the cost of your visit and maintain and accommodate you for the duration of your visit, or meet the cost of your onward or return journey. V4.2 (a, c, e)

The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) 4.2 of Appendix V: Immigration Rules for visitors because:

You state that you wish to visit the UK for 5 days for tourism.

In order to satisfactorily assess your intentions in the UK it is necessary for you to demonstrate your circumstances and ties to your own country of residence. You have stated in your visa application form that you are employed as a specialist at ***** in St Petersburg with a monthly income of RUB 57,500 or £755

I note that you have provided an employer’s letter, but you have provided no independent corroborative documents that verify your employment or income. You have provided no bank documents that show salary or tax documents. I am not satisfied that you are employed as you state.

To demonstrate your ability to pay for this visit you have submitted a bank certificate dated 28/07/2017 showing a balance of RUB 87,506 or £1149. You have not shown the origin of these funds and the letter from your bank is only a balance confirmation and does not show how long these funds have been held. I am therefore not satisfied that you have the funds available nor am I satisfied that you have shown how you are supported in your own country.

You have not demonstrated your circumstances and so I am not satisfied that you have demonstrated your intentions for this visit or that you have shown ties that mean you will leave the UK at the end of the visit as stated by you.

In light of the above, I am not satisfied you are genuinely seeking entry for a purpose that is permitted by the visitor routes or that you will leave the UK at the end of your visit. (Paragraph 4.2 (a) and (c) of Appendix V Immigration Rules for Visitors).

I am not satisfied that you will not will not undertake any prohibited activities set out in V 4.5 – V 4.10 of these rules. (Paragraph 4.2 (d) of Appendix V Immigration Rules for Visitors).

Given the fact that I am not satisfied as to your intentions I am not satisfied that you can meet your travel or UK living costs. I am not satisfied therefore that you have sufficient funds to cover all reasonable costs in relation to your visit without working or accessing public funds. (Paragraph 4.2 (e) of Appendix V Immigration Rules for Visitors).

The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) V4.2 of Appendix V: Immigration Rules for visitors because:

You have applied to travel to the UK for a period of 25 days from 20/12/2017 for the purpose of a family visit to see your husband in the UK. I note that you have previously been issued with a visa for the UK however I am satisfied that there has been a significant change in your personal circumstances.

At the time of your last application you were married to a Russian national who was resident in Russia and who was not intended to travel with you. You have now declared that you are married to a Moldovan national who is a permanent resident in the UK. You are currently unemployed and you intend to travel to the UK with your child. I am therefore satisfied that you have demonstrated that you have significant ties to the UK in the form of your spouse and that you have not demonstrated ties outside of the UK. I am therefore not satisfied that you intend to travel to the UK as a genuine visitor and that you intend to leave the UK at the end of the visit.

You have stated that you are unemployed and without savings, property or other sources of income.

I have considered the evidence and information submitted in your application; and on the balance of probabilities I am not satisfied that you have accurately presented your circumstances or intentions in wishing to enter the United Kingdom. This means that I am not satisfied that you are genuinely seeking entry as a visitor or that you intend to leave the United Kingdom at the end of your proposed visit; or that you have access to sufficient funds to cover all reasonable costs in relation to your visit without working or accessing public funds (this includes, but is not exclusively, the cost of the return or onward journey, any costs relating to dependants, and the cost of planned activities such as private medical treatment) Paragraph V 4.2 (a) (c) (e) of the Immigration Rules.

The Decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) V4.2 because:

You have applied for entry clearance to the UK for 6 months. The information you have provided on your application form and the supporting documents you submit allows me to assess whether your circumstances and intentions are, on the balance of probabilities, as stated.

On your Visa Application Form (VAF) you have stated that you are employed as manager for *****. As evidence of this you have submitted a letter. You are proposing to travel to the UK for 6 months to engage in preaching to a congregation of International Society for Krishna Consciousness. I acknowledge the letter from your UK sponsor. It is not clear why you are proposing to leave your employment and stay in the UK for so long. Nor is it clear whether you will have employment to return to in Russia. I do not find it credible that you would leave your job for so long. You have not provided any other evidence of your circumstances in Russia. Taking all the evidence into consideration I am not satisfied that your current circumstances are such that you are genuinely seeking entry for a purpose that is permitted by the visitor routes (Appendix 4.2 (c)). Nor have you have shown that your circumstances are such that you will leave the UK at the end of your visit (Appendix V 4.2 (a)).

I have therefore refused your application because I am not satisfied, on the balance of probabilities, that you meet all of the requirements of the relevant Appendix of the United Kingdom Immigration Rules.

    Добрый день! Подавала документы на гостевую визу в Великобританию. У подруги состоится свадьба. Приглашение от нее было получено на электронную почту. Все документы подготовлены и представлены. Но был получен отказ, по причине недоказанной близости с подругой. Можно ли что-то сделать для получения визы после отказа по данной причине? И какие документы подтверждают близость с подругой, если не факт приглашения на такое мероприятие?

      Добрый день, Анастасия! Вероятнее всего, в вашем случае есть и другая причина отказа в британской визе. Очень редко заявителям отказывают из-за недоказанной близости с принимающей стороной. Как правило, для подтверждения реальных отношений аппликанты прикладывают приглашение от друзей/родственников в Британии. Причем это должно быть не просто официальное сообщение в несколько строчек – адрес, телефон, фамилии, имена.

      Приглашение для визы в Великобританию – это подробное письмо с указанием примерных планов на поездку, а также с кратким рассказом о том, как вы познакомились, как поддерживаете контакт, часто ли встречаетесь, когда виделись в последний раз и т.д. Т.е. офицер не должен усомниться в том, что вы действительно друзья. Иногда заявители направляют в Посольство общие фотографии, доказательства совместных путешествий и пр.

      Но все же повторим: редко случаются отказы в визе из-за того, что офицер не поверил в реальность дружбы. Либо это действительно так, и ваши доказательства не были убедительными. Либо есть и другие причины. Например, в вашем финансовом благополучии. Просмотрите справки, полученные с работы и из банка, оцените их объективно. Помните, что низкий доход и/или небольшие накопления могут быть серьезным поводом для отказа.

      Также иногда аппликанты получают отказ из-за принимающей стороны. Возможно, у вашей подруги не все в порядке с историей переезда в Великобританию и/или получением постоянного статуса. Но если вы уверены, что таких проблем нет, и единственная причина – та, что указана в письме об отказе, то можно попытаться получить визу еще раз. Главное – расширить пакет документов и представить ситуацию как можно более убедительно.

    Здравствуйте! У меня официальное трудоустройство, но зарплату получаю наличными. Банковского счёта нет. Как подтвердить финансовую состоятельность, чтобы не было отказа в британской визе?

      Добрый день, Анна! Финансовую состоятельность требуется подтвердить документально. Если вы сами спонсируете свою поездку, то вам обязательно нужно подготовить справку о доходе и выписку из банка. Единственная альтернатива – бумаги от спонсора (супруг, родители). Если спонсора нет, то заявитель прикладывает свои документы. Учтите, что официальное трудоустройство не обязательно для Посольства. Более того, для Посольства не имеет значения, как вы устроены на работу. Главное – постоянный доход. Попросите работодателя подготовить подтверждение дохода. Это самая обычная справка о зарплате сотрудника.

      Отметим, что справка с работы для визы в Великобританию составляется в свободной форме. 2-НДФЛ прикладывать не нужно. Достаточно указать фактическую заработную плату, должность, стаж, контактные данные предприятия. В Налоговой службе проверять эти сведения Посольство точно не будет. Но справка с работы обязательна, без нее даже нет смысла обращаться за визой. Это же касается и выписки из банка. Но обращаем внимание: в справке о состоянии счета не должно быть указано, что вы открыли его только что и только что положили деньги. Можно ограничиться информацией о текущем остатке, без детализации.
